LITIGATION

The Firm’s Litigation Practice represents clients in state and federal courts and before alternative dispute resolution decision-makers in connection with a wide-variety of litigation matters, many of which are directly related to the Firm’s Business and Entrepreneurship Practice, Intellectual Property Practice and Civil Rights Practice. The Firm represents clients in many different types of civil disputes including contracts, securities, employment, fraud, construction, commercial landlord-tenant, real estate, entertainment, civil rights, copyright, trademark and unfair competition.

REPRESENTATION IN STATE AND FEDERAL COURTS

The Firm litigates commercial and non-commercial matters in state and federal courts. The Firm primarily represents clients in the state courts of New York, including courts sitting in the five boroughs of New York City, and the federal courts located in New York, including the U.S. District Courts for the Southern and Eastern Districts of New York. For representation of clients that have matters pending outside the State of New York, including in any international forum, local counsel in other jurisdictions may be engaged to assist in the representation, including filing papers and appearing before such courts. Individual attorneys licensed to practice in other jurisdictions may appear before courts in other jurisdictions or may appear pro hac vice, when appropriate.

ALTERNATIVE DISPUTE RESOLUTION

The Firm understands that litigation is not necessarily the most desirable means for resolving all disputes that arise between people or between companies, particularly those involving contracts, where the parties may need to continue to act pursuant to the contract at issue, and those involving closely-held companies, including family-run businesses. Accordingly, the Firm attempts to resolve issues for clients on an informal basis, whenever possible, in domestic and international matters. The Firm also resolves matters for clients through alternative dispute resolution, including mediation and arbitration, including representing clients in matters pending before the American Arbitration Association.
