This seminar will focus on the constitutional right against self-incrimination. The importance of exercising the right to remain silent as set forth in the famous Miranda case and its progeny will be discussed. Police interrogation tactics that are designed to obtain written or verbal statements from a suspect will be described. The right to consult with an attorney before giving any such statements, and the value of doing so, will be addressed. Trial and appellate concerns relating to the admissibility of statements obtained in violation of an accused person’s constitutional right to remain silent and right to consult with an attorney will also be discussed. Prosecutors and persons working for the District Attorney’s Office or law enforcement are not permitted to participate. Who should dial-in: All people who have been previously arrested and who believe this information could prove valuable to them in the future, as well as relatives and friends of accused persons who are concerned about their legal situation.
